The Advertiser (Adelaide, SA : 1931 - 1954) Fri 10 Nov 1950 Page 16 Law Courts: SUBURBAN GOODWOOD Sitting at Unley before Mr. G. H. Walters, S.M. Hotel Parking Area 'Public Place' In a reserved judgment yesterday in a case in which a man was charged with traffic' offences arising out of an accident on a hotel parking area, his Honor ruled that, although private property, the parking area was in reality a public place to which the provisions of the Road Traffic Act applied. Mr. S. J. Jacobs, for the defendant - Edward Hayley Bedford, a driver, of Rose terrace, Wayville - had contended that being private land the parking area at the Goodwood Park Hotel was not a public road as specified in the Act. His Honor added that as the owner of the hotel property 'invites the public to use the area for parking' and the evidence shows that the public uses it whether invited to or not, the area is a public place and the provisions of the Act apply. Bedford, the defendant, was convicted on charges that on August 12 at Goodwood he drove a motor car in the parking area at the southern side ol the Goodwood Park Hotel without due care and that on the same occasion he failed to stop after an accident. He was fined £5 on each count and ordered to pay £3 14/ costs.
