Advertiser and Register (Adelaide, SA : 1931) Tue 28 Apr 1931 TROUBLE OVER A CAT Man Fined For Assaulting Neighbor An allegation that a cat had eaten eight chickens led to neighbors laying charges of assault against each other in the Adelaide Police Court yesterday. Mrs. Edith Rose Vivian, of Portrush road, Glen Osmond, charged Clement Eli Goldfinch, of Queen-street, Glen Osmond, with assault. Goldfinch laid a counter-charge of assault against Mrs. Vivian. The magistrate found the charge against Goldfinch proved, and fined him £3, with £4 13/ costs. The charge against Mrs. Vivian was dismissed. Mr. H.M. Muirhead, S.M. was on the bench. Mr. P P. McCarthy appeared for Mrs. Vivian, and Mr. M.C. Kriewaldt for Goldfinch. Evidence was given by Mrs. Vivian that Goldfinch went to the front of her house and said. "Your cat has taken eight of my chickens. If you don't destroy the cat. I will." She did not reply to him. Shortly afterwards she saw Goldfinch in his backyard, and be again made reference to the cat. He wheeled his cycle into a lane, and said, "All right, you, if you won't listen to me, I will get the cops." She then ran down to Goldfinch, and said, "Did you mean that language for me?" Before she knew where she was he punched her in the eye, blackening it. Goldfinch followed her into her backyard, grabbed her round the neck, and tried to hit her again. A neighbor came in and separated them. She denied having assaulted Goldfinch or having thrown stones at him. She admitted that two cats had made their home at her place. If she had thought they had been taking chickens she would have had them removed. Goldfinch gave evidence that after breakfast he pushed his cycle to the side of the house, and heard Mrs. Vivian say to a neighbor, "He thinks more of his chickens than he does of his kids." He told Mrs. 'Vivian that "her cat had been at his chickens again," and pushed the cycle outside the gate. As he started the engine. Mrs. Vivian threw a stone, which hit him in the ribs. He looked up and saw another on its way. She took the bar of iron from the gate and went towards him with it. She threw more stones, one of which hit his child. He denied having struck Mrs. Vivian or having used bad language. Cross-examined by Mr. McCarthy, he said he had 105 head of poultry. He had had 25 chickens, and only eight were left.
