The Avertoser (Adelaide) Wednesday 17 August 1927 STOREKEEPER SUES HOTEL KEEPER. Before Mr. S. D. Ronald. S.M., in the Adelaide Local Court yesterday Vernon Leslie Reynolds, storekeeper, of Reynella, claimed £99 damages from G. I. Ferguson, licensed victualler, of Reynella in connection with alleged defamation. The plaintiff said that on or about December 17 last the defendant falsely and maliciously spoke and published the following words, 'Reynolds has been selling wine to the men working on the road constructtion.' Those words, it was contended, were intended by the defendant, and were understood to mean that the plaintiff, in breach of the Licensing Act, and under the cloak of carrying on the business of storekeeper, had illegally sold liquor, he being an unlicensed person. It was further alleged that the defendant uttered the following words, 'Reynolds has been carrying on sly grog with the men working on the road construction,' and 'Reynolds ougnt to be watched and prosecuted for sly grog. I myself have seen navvies carrying away wine from, his shop, and he is not the man to give wine away.'The plaintiff said he was injured in his credit, reputation, and trade in consequence of the remarks. The defendant pleaded that he I did not speak or publish the words complained of to any of the persons alleged by the plaintiff, that if the words were spoken or published it was without malice, and with the object of protecting the common interest of the defendant and of persons mentioned, and that they were reasonable and necessary for that purpose, and therefore, were privileged. Mr. F.G. Hicks appeared for the plaintiff, and Mr. W. A. Rollison for the defendant The hearing was adjourned.
