ARTICLES TAKEN AFTER SALE AT HOUSE
Auctioneer Sent To Gaol
Lancelot Lee Barnard, auctioneer, of Asquith street, Prospect Gardens, pleaded guilty in the Adelaide Police Court yesterday to a charge of larceny and was sent to gaol for 14 days by Mr. E. J. R. Morgan, SJM. Barnard was charged with having, at Unley on October 26, stolen a set of carvers, a wrist watch, and a brooch, valued in all at £4 5/, the property of Sadie Penn.
Miss Penn, of Arthur street, Unley, said she had an auction sale at her house on October 26, Barnard being the auctioneer. The next day she saw him at his office in Waymouth street. He said that he had been given some articles after the sale by a carrier, but had put them down under his bat and left them. When he went back they were missing. On another occasion Barnard told Miss Penn that nothing had been heard of the articles.
Robert Duncan Patrick Smith, clerk, said he had found some articles under a sideboard after a sale at Miss Penn's house and handed them to his employer.
Harold Scoble Wellington, carrier, of Queen street, Goodwood, said that the previous witness had given him some articles and he had passed them on to Barnard.
Plain clothes Constable Hanrahan said that on November 22, his company with Detective Copp, he saw Barnard at his office in Waymouth street. Barnard admitted that the articles in question were at his home, and they were subsequently found there.
Mr H. G. Alderman, who appeared for Barnard, asked that his client should be released on a bond to be of good behavior, as the offence charged was his first. Unfortunately, the articles were left in his car and apparently the idea entered his head to keep them.
Mr. Morgan said he took into account in mitigation of the offence Barnard's previous good character, and the fact that he had pleaded guilty, but he had stolen the articles while in a position of trust.
The Police Prosecuter (Mr. L. Bond) prosecuted.
