PEDESTRIAN RUN DOWN.
Motorist Fined at Hawthorn.
An accident in which a motor car ran over a man on Camberwell-road, Auburn, was investigated by Hawthorn court yesterday. Hugh Kelly, commercial traveller, of Park-road, South Camberwell, was charged with having driven in a dangerous manner. Herbert Wridgway, carrier, Deepdene, said at 6.45 p.m. on 11th April he was standing on Camberwell-road, Auburn, about nine feet from the water channel when defendant's motor car turned suddenly around from Burwood-road into Camberwell-road on tho wrong side. Witness tried to get on to the footpath out of the way of the car, but the car "seemed to chase him," and finally struck witness just when he had got to the gutter. Witness was tossed into the air as a result of the impact, and when he came to the ground again the car ran over him. To Mr. Hennessy (for the defence), witness said the car crossed the footpath after the accident and stopped on a vacant allotment. Witness was seriously injured, and had to undergo an operation. Symon Davey, hotel manager, said he was one of the men talking to the Iast witness when defendant cut the corner, travelling at, 20 to 25 miles an hour, on his wrong side of the road. Mr. Hennessy (for the defence) said his client had swerved to avoid the three men, who had no right to be talking on the road. Defendant said the men were on the left side of the road, which was witness's correct driving side. When Wridgway ran witness swerved to avoid him, but the mudguard of the car struck him. Witness was travelling at only 12 miles an hour. Mr. Wade, P.M., said if defendant was only going at 12 miles an hour he could easily have pulled up instead of trying to dodge the men. Defendant would be fined £5, with 30/ costs.

"NO CASE," SAYS JUDGE
Mrs. Isaacs Fails:
Waving her arms dramatically as she addressed the jury from the bar table, Mrs Edna Frances Isaacs unsuccessfully conducted her own case in a £5,000 action against a carrylng company in the County Court yesterday.
Judge Clyne ruled that on the evidence Mrs Isaacs had made no case He non-suited her with costs Mrs Isaacs said she would appeal.
She called several witnesses, but Judge Clyne ordered them not to answer many of her questions on the ground that they were irrelevant.
Mrs Isaacs alleged that Wridgway Bros (Auburn) Pty. Ltd, the defendants, wrongfully entered No 1 Goodall st, Auburn, on June 17, last year, and removed furniture and clothing which she claimed was hers. She had suffered great humiliation. She claimed delivery of the property, or £1,500 value-£1,500 for conversion of the property, and £2,000 for alleged trespass.
Defences of the company were that Judge Foster had declared the goods to be the property of John Isaacs, plaintiff's husband, and that everything was done on the authority of John Isaacs, and with the knowledge and permission of Sir Isaac Isaacs, beneficial owner of the premises.
Mrs. Isaacs told the Jury that defendants were at the house from 8 a.m. until about 7 p.m., and left it "with bare boards and bare walls." "I was even left stranded without a kitchen table or chair," she said. Herbert Wridgway, in evidence, said that nothing was taken from Mrs. Isaacs' bedroom.
Mrs. Isaacs called her husband as a witness. He said he did not instruct the carriers to take any food from the house, nor to take her clothes.
In answer to Mr. Smithers (for the company), Isaacs said he lived with his wife in Goodall st. until March l8.
Mr. Smithers.- Did she leave the premises on that date?- Yes; she deserted me.
Did you see her on April 16 and tell her she was not to come back to the house?- Certainly.
Mrs. Isaacs.- Were we married In the house.- Yes, unfortunately.
Why unfortunately? Didn't you think you were lucky?
Judge Clyne.- Don't answer that. You might say the wrong thing.
Mrs. Isaacs.- While I was In the house was the gas, electricity, and water cut off? - Yes, and also the telephone.
Mr. Smithers was Instructed by Messrs. P. J. Russell, Kennedy, and Cook.
