£234 Claim. In Land Dispute.
William Arthur Ryder Moyse, estate agent, of Adelaide, claimed £234/15/ in the Adelaide Local Court yesterday, in a dispute over the sale of property at Pekina and Glenelg, from Alfred G. E. Allen A., and Edwin W. Paech, farmers, of Glenelg, trading as A. Paech & Sons. The Paech's pleaded that the signature of A. G. E. Paech to the alleged agreement was given without their authority. Mr. M. Badger appeared for Moyse, and Mr. J. R. Kearnan for Paech & Sons. The hearing was adjourned until today.

DISPUTE OVER COMMISSION
In a case which came before Mr. S. D. Ronald, S M, in the Adelaide Local Court, on Monday. William Arthur Ryder Moyse, estate agent, of Grenfell-street, Adelaide, was the plaintiff, and Alfred Gustav Emmanuel Paech, Allen Alexander Paech, said Edwin Walter Paech, farmers, of Glenelg, trading as A. Paech & Sons, were the defendants. The plaintiff claimed £234 15/- for commission on the sale or exchange, dated May 1, 1930, of property or the defendants at Pekina and Glenelg to one Swincer, and alternatively for services alleged to have been rendered by him in procuring a purchaser, or in a further alternative against the defendant, A. G. E. Paech as damages on an allegation of having wrongfully prevented the plaintiff from earning the said remuneration in respect of procuring a purchaser. The defendants appeared, and pleaded that the signature of A. O. E. Paech to the alleged agreement was given without knowledge or authority of his sons, the other defendants, and that he had notified the plaintiff that he had no authority to bind his sons. It was contended further that the signature was given upon a verbal request that it would be retained by the plaintiff, pending further instructions and the approval of Swincer, and that before Swincer signed the alleged agreement A. G. E. Paech notified one Watkins, the agent of the plaintiff, on May 2, 1930, at Glenelg, that he did not propose to proceed with the transaction. It was also alleged by the defendants that the plaintiff procured the signature of Swincer to the alleged contract while knowing that the plain tiff was not then acting for the defendants, and that the defendants A. A. and E. W Paech, were not parties to the alleged agreement or the alleged sale or exchange, and did not at any time consent thereto. Mr. M. Badger appeared for the plaintiff. Mr. J. R. Keirnan represented the defendants. The hearing was adjourned until today.

William Arthur Ryder Moyse, Licensed auctioneer and land agent, of Wattle street, Malvern, gave evidence that Atkinson's land was, in his opinion, worth £1 an acre before the road was put through, and was now worth 2/6 an acre less. There was the possibility of a large number of sheep being killed on the road while it remained unfenced. The hearing was adjourned until today at Angaston.
