Evening Journal (Adelaide, SA : 1869 - 1912) Mon 21 Aug 1876 SUPREME COURT.-MATRIMONIAL CAUSES JURISDICTION. THIS DAY. ADELAIDE: MONDAY, AUGUST 21. [ Before Mr. Chief Justice Way.] . . . . THWAITES V. THWAITES. Mr. J. W. Downer for the petitioner. The respondent did not appear. _ Petition by the wife for dissolution of marriage on the grounds of desertion, adultery, and cruelty. From the affidavits it appeared that the petitioner, then Ellen Whitfield, was married to the respondent, Walter Wm. McClay Thwaites, formerly of Adelaide, photographer, at the Presbyterian Church, Oakbank, on September 23, 1865, by the Rev. John MacBean, M.A. The couple lived together till January 6, 1867, and there was a daughter born. On the date mentioned the respondent, without the knowledge or consent of his wife, left the colony under an assumed name, and went to Western Australia. His wife heard nothing of him till July, 1875. when she received a letter in which Thwaites said he purposed visiting the colony, and suggested that proceedings should be taken for a divorce. Having ascertained by the postmark that the letter was written from Carcoar, in New South Wales, the petitioner made enquiries and ultimately found out tkat her husband had committed bigamy by marrying a widow named Agnes Ann Francis, on May 2,1S7L This information was obtained in consequence of a report that Thwaites was dead, but on applying at the Registrar's office in New South Wales, she was furnished with the certificate of his efcond marriage. Steps were then taken for criminal prosecution, but the matter was :;b;.ndoaed in consequence of the respondent being beyond the jurisdiction of the South Australian Courts. The present whereabouts of the respondent are unknown, r.s he left Carcoar in fear of criminal proceedings. His father had informed the petitioner that her husband was in California, and intended to proceed to England. Substituted service of the petition was allowed by the Court. The Chief Justice said he should report to the Full Court that the petition had been fully proved. It would be satisfactory, however, although he had not much doubt on the point, if au&orities were produced, on moving for the decree, to show that the wife's domicile gave the Court jurisdiction. The Court then adjourned.
South Australian Chronicle and Weekly Mail (Adelaide, SA : 1868 - 1881) Sat 13 Jan 1877 Tuesday. January 9. [Before Mr. S. Beddome, P.M.,and Hon. W. Sandover, M.L.C., J.P.] . . . . Walter William IfcKean Thwattes was charged with committing bigamy, by marrying Margaret Ann Francis, at Casterton, New South Wales, the 2nd of May, 1871, while his former wife, Ellen Thwaites, of Whitfield,to whom he was married on the 23rd of September, 1865, at Inverbrackie, South Australia, was still alive. Mr. J. W. Downer prosecuted; Mr. Pater defended Mr. Downer having opened bis case, Mr. Pater objected that it must be shown by the prosecution that the case could go on in that Court, as the offence was alleged to have been committed in another colony. Mr. Beddome said by Act 8, of 1851, 1st section, Mr. Pater would see that a preliminary enquiry could take place in that Court. William Whitfield, draper, of Norwood said his sister, Ellen Whitfield, was married to the defendant by the Rev. J. MacBean at Inverbrackie, South Australia, on the 23rd of September, 1865. (Certificate of marriage was put in.) Defendant lived with his wife about a year, and then left her. He had never returned to her since. Mrs.Thwaites had had a child. (A letter, dated July 27, 1875, N.S. Wales, from defendant, was read, in which he stated his intention to revisit Adelaide; told his wife that her conduct had alienated his love, and advised a divorce). Witness had never seen defendant since two days after his child was born. Policer trooper Hall, stationed at Edithburgh, deposed to arresting the defendant, and finding in a box belonging to him a considerable number of letters addressed to the defendant in N.S. Wales. Some of these purported to come from his father in Tanunda, and others were signed, 'Your loving wife, Agnes.' When witness told defendant that some of the letters were signed by a person representing to be his wife, he said, 'Oh, then, that's proved.' (One of the letters purporting to be written by defendant's father was put in. It was dated Tanunda, September 18, 1875. The writer stated that as the offence was committed in New South Wales he did not think defendant could be prosecuted in South Australia. The writer regretted that defendant had, brought himself within the power of the law, as 'she' was very vindictive. If the statements were true, the writer said, defendant had acted very foolishly. His wife had had aspy on him for some time). Witness produced a certificate under the hand of the Registrar General, of New South Wales. (The certificate was one of the second marriage of defendant). By Mr. Pater Found the defendant carrying on business as a phot grapher in Edithburgh. Defendant was committed to prison, to be thence sent to New South Wales for trial. Bail was refused. . . . .

The Express and Telegraph (Adelaide, SA : 1867 - 1922) Fri 29 Sep 1922 PERSONAL NEWS. Mrs. Ellen Bails, who died this week was a daughter of Mr. Whitfield, of Oakbank, and was 75 years of age. During many years of her married, life she resided at Mannum, where she identified herself with philanthropic and church work. Her ever ready response to the call of the sick and needy endeared her to al. While she lived at Wayville she was an active worker, and Sunday teacher in the Baptist Church. She will be remembered by many friends.
Observer (Adelaide, SA : 1905 - 1931) Sat 7 Oct 1922 Page 25 OBITUARY: Mrs. Ellen Bails. The late Mrs. Ellen Bails was born at Oakbank 75 years ago, and was a daughter of the late Mr. Whitfield. During many yeans of her married life Mrs. Bails resided at Mannum, where she identified herself with philanthropic and church work. Her ever-ready response to help in the cause of the Sick and needy endeared her to all. Mrs. Bails also lived at Wayville, and was an active worker and Sunday school teacher in the Baptist Church. She possessed a kindly nature and wide sympathies.

(The following information is Courtesy of Lance Bails) On 17th January 1870 Ellen filed a suit for Judicial Separation No 134 in the Sth Aust Supreme Court, she stated at the time of the marriage she lived at Oakbank nr Woodside Sth Aust and that Thwaites was a photographer of Adelaide. The couple lived at Oakbank and in Adelaide. On 6th January 1867 Thwaites " without provocation or excuse left Sth Aust for West Aust under an assumed name and has remained apart " He left Ellen without support, she and the child now relied on her work, and that of relatives. Ellen further stated that prior to the separation Thwaites cruelly beat her and otherwise ill treated her without provocation. Divorce was granted on 18/12/1875 No 267 in Sth Aust Supreme Court.
